Newport Harbor Boat Rentals Inc. (“NHBR,” “we,” “our,” or “us”), located at 400 Main Street, Newport Beach, California 92661, provides boat rental services subject to the following terms. By visiting our website, making a reservation, signing a waiver, or operating a rental vessel, you acknowledge that you have read, understood, and agree to the policies outlined below. Returning customers who have previously signed an online waiver are not required to sign a new waiver for one year from the original signature date.
We are committed to protecting the privacy of our customers and website visitors. This section explains how we collect, use, disclose, and safeguard your personal information when you make a reservation, complete a waiver, or communicate with us.
We collect personal information that you voluntarily provide when making a booking, submitting a contact form, signing up for updates, completing a waiver, or communicating with us by phone, email, text message, or WhatsApp. This information may include your name, phone number, email address, mailing address, driver’s license number (when required for rental verification), billing and payment information, reservation details, and any other information you choose to provide during customer service interactions.
We use this information to process reservations, confirm bookings, verify renter eligibility, send rental reminders, provide operational updates, respond to customer inquiries, provide customer support, improve our services, prevent fraud or misuse of our vessels, and comply with legal or regulatory obligations. Where you have opted in, we may also use your contact information to send marketing communications. You may opt out of marketing communications at any time by contacting us at 949-200-8602 or newportharborboatrentals@gmail.com or by selecting ‘opt out’ of marketing messages via email or text message. We do not sell, rent, or trade your personal information to third parties for monetary value.
If you contact us via WhatsApp or provide your phone number for customer service purposes, you consent to receive service-related communications through WhatsApp, phone, or text message. These communications may include reservation confirmations, schedule changes, safety notifications, rental reminders, waiver confirmations, and responses to your inquiries. We do not use WhatsApp to send promotional or unsolicited marketing messages. Messages sent through WhatsApp are processed by Meta Platforms, Inc. and WhatsApp LLC solely for the purpose of delivering communications, and those providers operate under their own privacy policies.
We may share personal information with trusted third-party service providers who assist us in operating our business, including payment processors, reservation systems, waiver management platforms, technology providers, insurance providers when necessary, and messaging platforms. We may also disclose information if required by law, subpoena, court order, or lawful government request. We share only the information reasonably necessary to perform services on our behalf or meet legal obligations.
We retain personal information only for as long as necessary to fulfill the purposes described above, including maintaining business and financial records, resolving disputes, enforcing agreements, and complying with maritime, safety, tax, or other regulatory requirements.

A full refund will be issued only if cancellation is made at least 48 hours prior to the scheduled reservation time. Cancellations made less than 48 hours before the reservation are not eligible for a refund and will be subject to a $50 rescheduling fee. Customers who fail to appear for their reservation without prior notice (“no show”) will be charged the full reservation amount.
All rentals operate rain or shine. Refunds will not be issued due to stormy or inclement weather. In the event of extreme or unsafe weather conditions as determined by NHBR, a credit in the form of a gift certificate for unused rental time may be issued at our discretion.

Renters must be at least 21 years of age to reserve and operate 22-foot electric boats. Drivers are strictly prohibited from operating a vessel while intoxicated. NHBR reserves the right, at its sole discretion, to refuse rental and forfeit the security deposit if the driver appears impaired.
No more than 12 passengers, including infants, are permitted onboard at any time. All children 12 years of age and under are required to always wear a life jacket while the boat is in operation.
Rental periods begin at the reserved start time with no grace period. Rentals end at the scheduled return time, with a 10-minute grace period allowed. Boats returned after the 10-minute grace period will incur a late fee of $10 per minute. There are no refunds for unused time.
Renters agree not to anchor the vessel or tie off to buoys within Newport Harbor except in the case of an emergency. Violations may result in citations from Harbor Patrol, and renters are solely responsible for any fines, penalties, or citations incurred during the rental period. Renters agree to comply with all city, county, state, and federal regulations governing the operation of a motor vessel.
The rental vessel is strictly limited to operation within Newport Harbor, which extends to the mouth of the Newport Jetty. Under no circumstances may the vessel be taken outside Newport Harbor or into restricted areas identified on the provided harbor map. NHBR monitors vessel location via live GPS tracking. Entry into restricted areas will result in automatic forfeiture of the $500 security deposit at NHBR’s sole discretion.
A $500 security deposit is required for each rental and may be charged in the event of loss, damage, misuse, or violation of these terms. If damages exceed $500, the renter is responsible for the full cost of repair or replacement, up to and including full vessel replacement value (approximately $50,000).
During the rental period, full possession and control of the vessel is transferred to the renter. NHBR is not responsible for wrongful use or mismanagement of the vessel by the renter, nor for accidents, injuries, or losses caused by the renter to themselves or others, regardless of cause.
The renter acknowledges that the vessel and its equipment were delivered in good condition and agrees to return the vessel in the same condition. Any damage, loss of equipment, or required repairs will be charged to the renter upon return.
Accidents on the water, though rare, may occur. Renters are responsible for damage to NHBR vessels regardless of fault. If the renter is determined to be at fault for damage to another vessel or property, they may also be held liable. If NHBR’s insurance company becomes involved and charges a $500 deductible, that deductible will be added to the total damages owed.
If a rental vessel becomes entangled in a mooring line, buoy line, or similar obstruction, a $100 service fee will be charged for assistance. Additional charges may apply if lines must be cut or replaced.
By agreeing to these terms, renters authorize NHBR to charge the credit card on file for insurance deductibles, vessel damages, service calls, buoy or mooring line replacement, cleaning fees, or any other applicable charges, regardless of cause. If the credit card declines, payment by cash or alternate credit card is required immediately upon return. A valid driver’s license is required at the time of rental.
Swimming and water gun use from rental boats is strictly prohibited due to potential damage to onboard electronics. Evidence of violation will result in a $200 charge.
NHBR reserves the right to charge a $75 cleaning fee if the vessel is returned in a condition requiring additional cleaning beyond normal use.
